National Labor Relations Board Member to Address Regulation of the Non-Union Workforce

 
Key Developments and Q&A with Board Member Harry I. Johnson, III

Foley Hoag is honored to host Harry I. Johnson, III, Member of the National Labor Relations Board (NLRB), for an informative and interactive program addressing recent decisions that significantly impact non-union workforces.

The NLRB, the federal agency which conducts union elections and prosecutes employers for labor law violations, has issued a number of decisions guiding non-union work settings. As a result, companies whose employees are not represented by a labor union or undergoing union organizing are increasingly finding themselves before the Board. Just a few decisions have resulted in the following:

  • Ordering of reinstatement of workers fired for posting derogatory information about their employers on social media
  • Invalidating company policies and provisions in employee handbooks which many employers have long thought were standard and permissible, including concerning confidentiality and arbitration
  • Finding employers liable for asking employees to keep internal investigations confidential
     

Mr. Johnson will discuss key developments and provide you with an opportunity to ask your pressing questions. The program will be moderated by Jim Bucking, Chair of Foley Hoag’s Labor and Employment Department.

More About our Featured Speaker

Mr. Johnson was appointed by President Obama and confirmed by the U.S. Senate as a member of the Board in August 2013. He was in private practice prior to joining the Board. Mr. Johnson received a B.A. from Johns Hopkins University, a M.A.L.D. from Tufts University, and a law degree from Harvard Law School.
